For over 15 years, Mark Kirkland has effectively and aggressively represented community and homeowner associations, businesses, commercial associations, and property owners in high value, complex construction disputes from intake through resolution. After over a decade of success at some of California's largest construction and HOA firms, Mark now brings his results-focused, client-driven advocacy to a modern boutique law firm.
Litigation and trial matters cannot resolve at the appropriate value unless the handling attorney, like Mark, has substantial litigation and trial experience to demonstrate the skills and resolve to secure superior client outcomes. Mark's trial results include a large confidential settlement following a multiple-unit, 18-day residential construction dispute jury trial, as well as arbitrating 12 construction matters to award. Mark has obtained successful results, as first or second chair, in over 20 complex jury trials and dozens of arbitrations. He has taken or defended hundreds of depositions. As a defense attorney, Mark has secured dismissals of claims against his clients while recovering attorney's fees.
In Mark's growing general and corporate counsel practice, he offers effective and practical guidance to contractors and homeowner associations of all forms and sizes. Mark's experience with a diverse list of clients and experts gives him the breadth of knowledge to protect the interests of your business or community at a reasonable cost. As outside counsel, Mark provides pre-litigation dispute resolution, risk analysis, and legal support for project management. Whether you need contract negotiation, drafting, operational counsel or advice regarding corporate governance, Mark's will provide his clients with effective and efficient guidance to navigate their challenges and the evolving construction industry.
In his spare time, Mark enjoys spending time with his wife and daughter, playing with his 2 rescues, weightlifting, and motorcycling.
